General Terms and Conditions (GTC)       

1. subject of the contract
The following terms and conditions apply to the ordering and delivery of products and accessories which the customer has ordered from reftools gmbh.

2. exclusive validity of the GTC
Within the scope of these services the following general terms and conditions apply.

3. conclusion of the contract
All offers of reftools gmbh are without obligation. The contract between the customer and reftools gmbh is only concluded by an order of the customer and its acceptance by reftools gmbh. Orders of the customer can be placed online, with order form, by email or by phone. reftools gmbh accepts the order verbally or by confirmation by e-mail.

4. delivery
The delivery takes place ex reftools gmbh or ex producer. The delivery time is normally 2-5 working days. For individually manufactured products or items that are not in stock, the delivery time is usually 2-4 weeks. reftools gmbh attaches great importance to state availability and delivery times in the online shop in an up-to-date and accurate manner. Especially due to production or delivery bottlenecks, reftools gmbh may experience delays in delivery. All information about availability and delivery time are therefore without guarantee and can change at any time.

5. reservation of proprietary rights
The reftools gmbh reserves the right of ownership of the ordered goods until the customer has fully paid the purchase price from the current order.

6. payment / shipping costs
The purchase price is due with the order. The customer can make payment in advance (prepayment) by inpayment slip, credit card (EUROCARD/VISA) or PostFinance, Debit Direct. Shipping costs are shown separately and are included in the total amount. Deliveries abroad are made without Swiss VAT. However, the items are subject to VAT. rates of the respective countries and are charged directly by the delivering postal service. For deliveries abroad, a customs fee is usually charged by the customs office.

7. delay
If the customer is in arrears with his payment, the deliveries will be withheld until proof of payment has been provided.

8. right of return
The reftools gmbh grants the customer the right to return the ordered goods to reftools gmbh within 7 days from the date of delivery if the customer does not like the goods. Excluded from the right of return are articles in clearance sale and individually manufactured products. The shipping costs are at the expense of the customer. Only absolutely unused and unworn goods in original packaging may be returned. The return address is: reftools gmbh, Schönbühlstrasse 8, 8635 Dürnten, Switzerland. The paid amount will be refunded immediately and in full after receipt of the goods. If the customer receives damaged goods, a complaint will only be accepted if it is sent immediately by e-mail, fax or telephone and the goods are returned immediately. In this case the costs for the return shipment will be paid by reftools gmbh and the full purchase price will be refunded promptly after arrival of the damaged goods or replaced in an equivalent way.

9. liability
In connection with orders or deliveries reftools gmbh is in no case liable for damages incurred by the customer in connection with the delivery, late delivery or non-delivery of products, as well as damages resulting from the use of delivered products - also not for loss of profit or other financial losses of the customer. Otherwise reftools gmbh is liable only up to the amount of the proven damage (at most up to the value of the goods). No guarantee is given for minor product deviations. Colour, design or technical changes are reserved.

10. data protection
Personal data of the customer are only collected within the scope of the legal regulations. All data transmitted in the course of the order will be stored internally by reftools gmbh exclusively for this business case and will not be made accessible to third parties. The employees of reftools gmbh are subject to the obligation of secrecy.

11. conditions of participation reftools referee quiz

This competition is organised by reftools gmbh, Schönbühlstrasse 8, 8635 Dürnten, Switzerland. The competition is not affiliated with Facebook, Instagram and other social networks and is not sponsored, supported or organised by them.
All persons resident in Switzerland are eligible to participate. Employees are excluded. The winners will be notified in writing. No correspondence will be entered into regarding the competition. A cash payment is not possible. Legal recourse is excluded. Participation in the prize draw is independent of a product order or purchase. The period for participation in the competition will be announced in connection with the respective competition.
Prizes relating to participation in an event are valid in the name of the person taking part and are not transferable to third parties.
We at reftools reserve the right to ask for your consent to publish the contribution you have submitted (photo, video, text, etc.) including your name.

12. final provisions
Should one or more provisions of these GTC be invalid, this shall not result in the invalidity of the entire contract. The invalid provision will be replaced by the relevant statutory provision. Swiss law is exclusively applicable to this contract. The place of jurisdiction and performance is 8635 Dürnten.
